1.Introduction
This Privacy Policy explains how TalkSensy (“TalkSensy”, “we”, “us” or “our”) collects, uses, shares and protects information when you visit our website, create an account, or use our WhatsApp engagement platform and related services (the “Service”).
TalkSensy helps businesses run campaigns, manage customer conversations, automate replies, capture leads and track outcomes on the WhatsApp Business Platform. By using the Service, you agree to the practices described here. If you do not agree, please do not use the Service.
2.Our role: controller and processor
Our privacy responsibilities depend on whose data is involved:
- As a controller — for information about you as our customer (your account, billing and how you use the Service), we decide why and how it is processed.
- As a processor — for the contact lists, messages and customer data you upload or send through the Service, we process that data on your behalf and under your instructions. You are the controller of your customers’ data and are responsible for having a lawful basis (including valid opt-in and consent) to process it.
3.Information we collect
Information you provide
- Account information — name, business name, email address, phone number, and login credentials.
- WhatsApp Business Account details — your WABA ID, phone number, display name and related configuration needed to connect to the WhatsApp Business Platform.
- Billing information — plan selection, billing address and tax details. Card and payment details are collected and processed by our payment providers, not stored by us.
- Content you create — campaigns, message templates, automation flows, forms, catalogues and notes.
- Contacts and customer data — the phone numbers, names, tags, attributes and other details you upload or that are captured from conversations.
- Message content — the WhatsApp messages sent and received through your connected number, including text, media and metadata such as delivery and read status.
- Support communications — messages you send us for support, feedback or enquiries.
Information we collect automatically
- Usage data — features used, actions taken, pages viewed and timestamps.
- Device and technical data — IP address, browser type, operating system, device identifiers and approximate location derived from IP.
- Cookies and similar technologies — used to keep you signed in, remember preferences and understand how the Service is used (see “Cookies” below).
Information from third parties
We receive data from Meta Platforms (WhatsApp Business Platform) about your messaging — such as message status, quality ratings and conversation metrics — and from integrations you connect (for example your store, payment provider or sheets) to the extent you authorise them.
4.How we use information
We use the information described above to:
- Provide, operate, maintain and secure the Service;
- Connect and manage your WhatsApp Business Account and deliver your messages and campaigns;
- Authenticate you and manage your account, team members and permissions;
- Process subscriptions, calculate usage-based fees and issue invoices;
- Provide analytics and reporting on campaigns, replies, leads and team performance;
- Provide customer support and respond to your requests;
- Detect, prevent and investigate fraud, abuse, spam and security incidents;
- Send you service, security and billing notices, and — where permitted — product updates you can opt out of;
- Comply with legal obligations and enforce our Terms & Conditions.
We do not sell your personal information, and we do not use the content of your customers’ messages for advertising.
5.WhatsApp and Meta
The Service is built on the WhatsApp Business Platform provided by Meta. When you send or receive messages, that content is transmitted through and processed by Meta in accordance with the WhatsApp Business Messaging Policy and Meta’s own terms and privacy policy. Your use of WhatsApp through TalkSensy is also subject to those policies, including obtaining opt-in from recipients before messaging them.
Meta WhatsApp conversation charges are billed by Meta at actuals and are separate from TalkSensy’s platform fees.
7.Data retention
We retain personal information for as long as your account is active and as needed to provide the Service, then for the period required to comply with our legal, tax and accounting obligations, resolve disputes and enforce our agreements. You can delete contacts and content within the Service; message and log data may persist in backups for a limited period before being overwritten. On account closure we delete or anonymise your data within a reasonable period, except where retention is required by law.
8.Data security
We use technical and organisational measures — including encryption in transit, access controls, and monitoring — designed to protect your information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. You are responsible for keeping your login credentials confidential and for managing your team members’ access.
9.Your rights and choices
Subject to applicable law — including India’s Digital Personal Data Protection Act, 2023, and, where relevant, the GDPR — you may have the right to:
- Access the personal information we hold about you;
- Correct inaccurate or incomplete information;
- Request deletion of your personal information;
- Withdraw consent where processing is based on consent;
- Object to or restrict certain processing;
- Request a copy of your data in a portable format;
- Nominate another individual to exercise your rights in the event of death or incapacity, as provided under applicable law.
To exercise these rights, contact us at support@talksensy.com. Where we act as a processor on your behalf, requests from your customers should be directed to you, and we will assist you in responding. You can also opt out of marketing emails using the unsubscribe link in those messages.
11.International data transfers
We and our service providers may process and store information in countries other than where you are located. Where we transfer personal information across borders, we take steps to ensure it is protected consistent with this Policy and applicable law.
12.Children
The Service is intended for businesses and is not directed to individuals under 18. We do not knowingly collect personal information from children. If you believe a child has provided us personal information, contact us and we will take appropriate steps to delete it.
13.Changes to this Policy
We may update this Privacy Policy from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you through the Service or by email. Your continued use of the Service after changes take effect means you accept the updated Policy.
